New Jersey Mini-WARN Act

Many states, New Jersey included, have so-called mini-WARN laws. These laws require advance notice in the event of plant shutdowns or mass layoffs. The New Jersey law was amended just on the eve of the COVID outbreak. The amendments were delayed but now will take effect April 10, 2023.The specifics of the New Jersey WARN Act are beyond the scope of this article.

One aspect of the amendments relates to the requirement that one week of severance per year of service must be provided to impacted individuals. Further, this amount is increased by four weeks if the employer does not provide advance (90 days) notice of the mass layoff, transfer, or termination of operation.

Litigation is pending in the New Jersey District Court (The ERISA Industry Committee v Robert Asaro-Angelo) relating to this aspect of the law.

Employers in New Jersey who could potentially be impacted will want to keep an eye on this litigation.
