Massachusetts Updates: Health Insurance Responsibility Disclosure Requirement and Paid Family Leave

The Health Insurance Responsibility Disclosure (HIRD) form is a state reporting requirement in Massachusetts which collects employer-level information about employer-sponsored insurance offerings. Employers with six or more employees must submit a HIRD form annually.

The HIRD reporting is administered by MassHealth and the Department of Revenue through the MassTaxConnect web portal. The HIRD form will be available to be filed starting November 15 and must be completed by December 15 of the reporting year. This form is to be completed electronically on MassTaxConnect and paper forms or any substitution of the form will not be accepted.

As a reminder, beginning January 1, 2023, the contribution rate for Paid Family and Medical Leave will decrease to 0.63% of eligible wages up to the Social Security wage base ($160,200 in 2023) and the maximum weekly benefit amount will be $1,129.82.

Employers must provide written notice of the new contribution rate 30 days in advance of the rate change (December 2, 2022, for the January 1, 2023, effective date). This notice may be provided electronically. The Department of Family and Medical Leave has 2023 contribution rate sheets available on its website for downloading.

In addition, employers must display a workplace poster at its workplace in a location easily accessible to employees. The Department of Family and Medical Leave has prepared a 2023 workplace poster for an employer’s use.
