Delaware Issues Notice of Employee Rights for Paid Family Leave

Delaware’s paid family and medical leave law provides up to 12 weeks of leave for certain parental, family caregiving, and medical reasons. The program will be funded by employer and employee contributions, with contributions beginning January 1, 2025, and paid leave benefits beginning January 1, 2026. Delaware’s Department of Labor has issued FAQs and key steps for employers to prepare for the paid family leave law on its website. As of September 1, employers employing 10 or more Delaware-based employees must register through LaborFirst, the state system to manage paid leave. Registration must be completed by December 1, 2024. Employers wanting to use a private plan can apply for a private plan exemption during this same time period through LaborFirst.

Beginning January 1, 2025, employers must display a workplace poster in a conspicuous location at the place of business in English, Spanish, and any other language that is the first language spoken by 5% or more of the employer’s workforce. The Delaware Department of Labor has provided a Model Notice of Employee Rights to comply with the posting requirement.
