San Francisco Employer’s to Provide Paid Military Leave

On January 20, 2023, San Francisco Mayor London Breed signed the Military Leave Pay Protection Act which requires private employers in San Francisco employing 100 or more employees (regardless of location) to provide differential paid leave for military reservists called up to active duty beginning February 19, 2023.

An employee shall receive from his/her employer, while on leave for Military Duty, the difference between the amount of the employee’s gross military pay and the amount of gross pay the employee would have received from the employer, had the employee worked the employee’s regular work schedule (excluding overtime).

An eligible employee is one who works within the geographic boundaries of San Francisco and who is a member of the reserve corps of the United States Armed Forces, National Guard, or other uniformed service organization of the United States.

An employee will be able to take military duty paid leave in daily increments for one or more days at a time, for up to 30 days in any calendar year.

If an individual does not return to work within 90 days after release from duty, the ordinance allows the military payment to be treated as a loan. Further guidance will hopefully be issued.

The Office of Labor Standards and Enforcement (OLSE) will be tasked with implementation and enforcement of the ordinance. Employers will want to keep an eye on the OSLE website for further guidance.
