Reminder: Paid Leave Begins in Several States

As of January 1, 2021, paid leave took effect in the following states: Colorado, Maine, Massachusetts and New York.

Colorado employers employing 16 or more employees are to provide up to 48 hours of paid sick leave in a year. Additionally, Colorado’s supplemental leave for a public health emergency took effect January 1, 2021.The supplemental leave applies to all employers, regardless of size, and provides up to 80 hours of supplemental paid sick leave in the event of a public health emergency (see prior Benefit Beat article)

Employers in Maine employing 10 or more employees are to provide up to 40 hours of paid leave in a year to be used for any purpose (see prior Benefit Beat article).

Employees in Massachusetts are eligible to take paid family leave as of January 1, 2021.An employee is eligible for up to 12 weeks of paid family leave for the birth, adoption, or foster care placement of a child, or due to a qualifying military exigency; or, up to 20 weeks of paid medical leave for one’s own serious health condition (see October 2020 Benefit Beat article and September 2020 Benefit Beat article).

New York’s state-wide paid sick leave law took effect January 1, 2021.Employers in New York are to provide either 40 or 56 hours of paid sick leave dependent upon certain factors (see April 2020 Benefit Beat article).

As a reminder, New York City’s paid sick leave ordinance was amended in September 2020 to align with the state’s paid sick leave law (see prior Benefit Beat article).
