Washington DC Updates: PFL and New Wage Transparency Law

Paid Family Leave

DC’s paid family leave (PFL) provides up to a max of 12 weeks of leave in a year for parental leave, family leave, or medical leave. Eligible employees can also take up to 2 weeks for prenatal leave. See prior Benefit Beat articles here and here.

Covered employees can receive up to 90% wage replacement during his/her period of leave. The maximum weekly benefit amount for parental, family or medical leave claims beginning on or after October 1, 2023, is $1,118.

Covered employers have an obligation to provide a model notice to employees as follows:

  • Post the employee notice in a visible place that is accessible to all workers, as well as translated versions for employers with non-English speaking employees.
  • Provide existing employees with a copy of the notice on an annual basis by February 1.
  • Provide to all new employees at time of hiring.
  • Provide upon learning of an employee’s right or need to take leave.

Wage Transparency

On January 12, Mayor Muriel Bowser signed into law the Wage Transparency Omnibus Amendment Act of 2023 which amends the DC Wage Transparency Act of 2014. This law is scheduled to take effect June 30, 2024, pending Congressional approval.

Employers who employ at least one employee in the district, except for the district and federal governments, shall provide the minimum and maximum salary or hourly pay in all job listings and position descriptions advertised. Employers must also disclose to prospective employees the existence of healthcare benefits that employees may receive.

Employers are prohibited from screening prospective job applicants based on his/her salary history. Employers will be required to post a notice in their workplace notifying employees of their rights under this law. The notice shall be posted in a conspicuous place in at least one location where employees congregate.
