The U.S. Equal Employment Opportunity Commission (EEOC) has announced the opening and deadline for the 2024 EEO-1 Component 1 data collection. With the approval of the EEO-1 Instruction Booklet by the Office of Management and Budget (OMB), the EEO-1 portal opened on May 20, 2025, with a filing deadline of June 24, 2025.
What is the EEO-1 Report?
The EEO-1 Report is a federally required workforce survey that collects data on race, ethnicity, sex, and job categories. Employers subject to Title VII of the Civil Rights Act are generally required to submit EEO-1 Reports annually by March 31. For 2024, however, the EEOC has extended the deadline to June 24, 2025.
Who Needs to File?
The following entities are required to submit EEO-1 Reports:
- Private employers with 100 or more employees, excluding certain organizations like schools.
- Private employers with 15–99 employees, if they are part of a group of businesses that collectively employ 100 employees or more.
- Federal contractors with 50 or more employees and contracts, subcontracts, or purchase orders of $50,000 or more.
Although Executive Order 11246, which required federal contractors to submit EEO-1 Reports, was revoked under the Trump administration, the EEO-1 Instruction Booklet still references this requirement for 2024 filings.
Key Changes: No More Nonbinary Reporting
In previous years, covered entities could voluntarily report employees who self-identified as “nonbinary” when indicating their sex. For 2024, the proposed Instruction Booklet removes this option, requiring employers to report sex as either male or female.
What Employers Should Do Now
