Washington’s LTC Class Action Lawsuit Dismissed

The circuitous path of the Washington long term care law continues. As a reminder, the state of Washington passed a mandatory long term care law. See prior Benefit Beat articles here, here, and here.

In November 2021, a class action lawsuit challenging the long-term care program was filed, see prior Benefit Beat article here.

On April 21, 2022, Judge Thomas Zilly, U.S. District Court for the Western District of Washington, dismissed the class action lawsuit indicating that federal court did not have jurisdiction since it was a state tax and any legal challenge to the law must be brought in state court.
