Problem

A large public board of education was experiencing claim denials due to late reporting. Our team determined there was a knowledge gap regarding the claims process. Specifically, there was a lack of understanding for when an issue may result in a claim and therefore need to be reported.

Solution

The first step our team took was to work with the insurers to identify which positions at the school who receive potential or actual claim notices constitute as “notice” under the policy. We then prepared and conducted training to educate the individuals in these roles on how to determine if a communicated issue should be reported as a possible claim. These small group trainings included education on claims reporting obligations. We also developed an ongoing claims review process and send an annual reminder of claims notification obligations to key employees.

Outcome

This formal process and education resulted in the client meeting the reporting deadlines for possible claims and eliminating claim denials due to late reporting. It also meant the client no longer had to pay for the defense and indemnity issues associated with the claim from their own funds. The properly reported claims are now handled by the insurer.
