Preventive Services Under Fire

A recent U.S. District Court for the Northern District of Texas case, Braidwood Management Inc. Et al, v. Xavier Becerra et al. bares watching. In this matter, a group of plaintiffs are challenging the Affordable Care Acts’ preventive requirements. One of the lynchpins of the ACA is first dollar coverage of an ever-changing list of preventive services. The philosophy being an ounce of prevention is worth a pound of cure. The ACA gave authority to three entities, the U.S. Preventive Services Task Force (PSTF), the Advisory Committee on Immunization Practices (ACIP), and the Health Resources and Services Administration (HRSA) to regularly review and update what types of immunizations are to be covered. In summary this lawsuit challenges the authority of these entities it also challenges the law based on the Religious Freedom and Restoration Act (RFRA).Very importantly, at this point nothing has changed with regard to the requirements for plans to cover preventive services at no cost to the participant. Though certain matters are continuing to be reviewed it will be important to keep an eye on the evolution of this litigation.
