On March 12, 2021, Governor Cuomo signed a law requiring employers to provide paid leave for the COVID vaccine. The law took was to be repealed on December 31, 2022.On June 28, 2022, Governor Hochul signed a law extending the leave for the COVID vaccine until December 31, 2023.

As a reminder, the law applies to public and private employers and requires employers to provide its employees with up to four hours of paid leave per vaccine injection (up to 8 hours total for two injections).

The Department of Labor has FAQ guidance on its website. The FAQs clarify the law only mandates paid leave for employees receiving vaccinations on or after March 12, 2021 and the leave is only available for an employee to get vaccinated; the leave may not be used to assist a relative or another individual in getting vaccinated.
