San Francisco: Annual Health Care Ordinance Reporting Reminders and Expenditure Rates for 2011

Reporting Reminders

To avoid penalties and other corrective actions, businesses subject to the Employer Spending Requirement of San Francisco’s Health Care Security Ordinance (HCSO) must complete and submit the Annual Reporting Form by April 30, 2010.  Below are links to a worksheet and the annual report:

Self-employed individuals, independent contractors, employers with 19 or fewer employees total (including any employees located outside of San Francisco), and nonprofits with 49 or fewer employees total (including any employees located outside of San Francisco), are not covered by the HCSO and should not return the Annual Reporting Form.

In addition, the Office of Labor Standards Enforcement has recently revised its collection of Frequently Asked Questions relating to the Employer Spending Requirement.

Expenditure Rates for 2011

Covered employers who are subject to San Francisco’s Ordinance are required to make health care expenditures (HCE) to, or on behalf of, their covered employees.  These expenditure amounts are adjusted annually, in accordance with the San Francisco Ordinance.  Nonprofit entities with fewer than 50 employees, and small employers (those with fewer than 20 employees) are exempt from these provisions.
