New Rules for Tax Exempt Organizations Allows States More Access to Internal Revenue Service Records (article)

The 2006 Pension Protection Act (PPA) expanded the ability of the Internal Revenue Service (IRS) to disclose information to states concerning §501(c)(3) organizations and applicants as well as certain other exempt organizations. In 2011, the IRS issued Proposed Regulation §301.6104(c)-1, which provides guidance regarding these additional disclosures.

Work Opportunity Credit for Qualified Veterans Expanded (article)

Last fall’s VOW to Hire Heroes Act of 2011 (“VOW Act”) expanded the targeted groups for which the Work Opportunity Tax Credit (“WOTC”) can be claimed to include two additional groups of qualified veterans. The VOW Act also extended the WOTC for hiring qualified veterans through 2012 (the credit expired for all other targeted groups on December 31, 2011).

Reminder: Triennial HIPAA Privacy Notice Obligation

Large group health plans that became subject to the HIPAA Privacy Rules by April 14, 2003 are fast approaching the 9th anniversary of HIPAA privacy applicability. This means that it is time to distribute the triennial reminder notice to covered individuals regarding the availability of their Notice of Privacy Practices and how to obtain one.

Medicare Part D Reminder: Annual Disclosure Notice to CMS

Group health plans are required to submit an annual report to CMS describing whether the prescription drug coverage is creditable or not creditable. This filing must be accomplished electronically, and is due within 60 days of the beginning of the plan year. For calendar year plans, this means March 1, 2012.  CMS provides guidance and instructions to assist in completion with this annual reporting requirement.
