Paid Sick Leave Updates in San Antonio and Duluth
Practically on the eve of its effective date, the San Antonio paid sick and safe leave ordinance has been stayed by court order. And, the City of Duluth released final rules and updated FAQs to assist employers with their compliance of the law, which takes effect January 1, 2020.
Nevada’s “Leave for Any Purpose” Law Clarified
The Nevada Labor Commissioner issued an advisory opinion together with FAQs to clarify certain aspects of the state’s recently enacted “leave for any purpose” law, which takes effect January 1, 2020. Of particular note, this guidance addresses how to determine employer size and the requirement to include information about the leave benefit in the employer’s workplace policies.
HHS Increases Penalties for Compliance Failures
Employee benefit plans are subject to oversight by several government regulatory agencies including HHS, DOL and IRS. These agencies may adjust certain monetary civil penalties for compliance failures. To this end, HHS recently made adjustments in civil penalties for violations of the HIPAA privacy, security and breach rules, the failure to provide the SBC to plan participants, as well as violations relating to the Medicare secondary payor rules.
Informational Form 5500 Issued for 2019 Plan Reporting
The governing agencies released advanced informational versions of the 2019 Form 5500 series. Plan administrators of both welfare benefit and pension plans subject to ERISA, with certain exceptions, are required to file a Form 5500 return/report with the DOL on an annual basis.
2020 Medicare Premiums and Deductibles
The 2020 premiums and deductibles for the Medicare Part A and Part B programs have been released by the Centers for Medicare & Medicaid Services.
2020 Pension and Retirement Plan Limits
The 2020 cost of living adjustments applicable to defined benefit and defined contribution plans have been released by the IRS. Notably, the majority of all limits have increased from last year.
2020 Benefit Plan Limits
The IRS released several 2020 cost of living adjustments for various aspects of benefits including the flexible medical spending account cap, transportation and adoption assistance benefits, Archer MSA limits, long term care premium, the small business tax credit and small employer health reimbursement arrangements, the premium tax credit for coverage under a qualified health plan, plus announced an increase in certain reporting and disclosure penalties.
